Lease Agreement

Hereafter referred to as THE LANDLORD.

AND

CHANG CHENG ESQUARES CO LTD represented by Mr ………………………….Bearer of the

Hereafter referred to as THE TENANT.

THE TENANT AND THE LANDLORD HAVE HEREBY COVENANTED AND AGREED TO AS

FOLLOWS:

1 LEASE

1.1 The landlord agrees to let and the tenant agrees to rent the leased premises set out under Clause 2

on the terms and conditions set out hereunder.

1.2 The landlord warrants to the tenant that he is the lawful owner of the premises and has full power

to enter into the lease agreement and does not require the consent or approval of any other person or

authority.

1.3 The tenant undertakes to ensure compliance with the terms and conditions of the lease agreement.

PREMISES

2.1 The LEASED PREMISES are situated at Avenue Faucon ,Quatre Bornes and are let furnished.The premises let are the YARD, and GROUND FLOOR :garage,kitchen, diningand living

room,one bedroom, one toilet, FIRST FLOOR:three bedrooms,T.V room,one toilet, bathroom and

balcony.

3.DURATION, VACATION AND RENEWAL

3.1 The present lease is made for a period of 12 months as from the 1st July 2009.It could be extended

for subsequent period of 12 months or of not le than 6 months as may be mutually agreed by the

Landlord and the Tenant.

3.2 The premises let may be vacated or the lease renewed, if notice to the landlord has been duly given

in writing by the Tenant to the Landlord at least three months before the expiry of the present lease.

The Landlord reserves the right to approve or disapprove the renewal of the lease.

3.3 In case of renewal the Landlord may, at his discretion, increase the rent by a percentage rate

indexed on inflation rate.

3.4 Except in the event of \'\'FORCE MAJEURE\'\' if the Tenant vacates the leased premises before the

expiry of the lease without giving a due notice of three months in advance to the Landlord, he shall

be liable to pay the equivalent of three months rent that is FIFTY-FOUR THOUSANDS

RUPEES(54,000) to the landlord as indemnity.It apply for both parties.

4 RENT

4.1 The consideration of the lease shall be Rs EIGHTEEN THOUSAND RUPEES(Rs 18,000) per month.

4.2 The rent is payabe in advance at latest on the 3rd day of each month.

4.3 Notwithstanding the provisions of clause 4.2 above the Tenant hereby agrees to pay ONE MONTH DEPOSIT,EIGHTEEN THOUSAND(RS18,000)

5.CHARGES

5.1 The Landlord shall be responsible for all rates and taxes presently aeed or leviable in respect of the leased premises.

5.2 The Tenant shall pay all charges for water and electricity supplied to the leases premises.

5.3 The Tenant shall be responsible for all telephone and fax charges(rental, inland and international) accruing to his account while residing on the premises during the tenancy.

5.4 Either as and when required or at the expiry of the tenancy, all receipts in respect of the charges under clauses 5.3 above shall be submitted to the Landlord for security.

6.ASSIGNMENT OR SUBLETTING

6.1 The Tenant shall not aign or sublet the whole part or part of the leased premises to anyone without the prior consent of the Landlord.

7.MAINTENANCE, REPAIRS AND ALTERATIONS:

7.1 The tenant shall not make any alteration to the leased premises without the written consent of thelandlord; and where any alteration is authorised the cost there of shall be borne by the tenant.

7.2 The tenant shall;

a)Keep the premises clean and in good and tenantable conditions.

b) For the repairs of or replacement , of all fittings, fixtures and acceories such as

but not limited to the toilet, washbasin and electrical appliances as shall be broken,

lost, damaged or destroyed during the tenancy, fair wear and tear excepted.

7.3 Where any structural defect to the leased premises come to light during the tenancy, the tenant shall forthwith inform the Landlord of such defect and the Landlord shall thereupon cause such defect to be repaired or remedied at his own expenses with due diligence.

7.4 T he tenant shall allow the landlord or any other person duly authorised by the landlord to inspect the lease premises at all reasonable times by prior agreement with the tenant to satisfy himself that theprovisions of this clause are being complied with.

8.INSURANCE

8.1 The Tenant shall take out an appropriate insurance policy to cover the Tenant\'s risk and his personal belongings against fire, cyclone, flood, theft or any other insurable aets or event.

9.USE OF THE LEASED PREMISES

9.1 The leased premises shall be used for RESIDENCIAL purposes and the tenant may not change or alter the use of the premises without the prior written consent of the landlord.

9.2 The Tenant shall not cause any nuisance or make any noise that is likely to disturb the quiet andpeaceful occupation of his neighbours.

10.TERMINATION OF CONTRACT.

10.1 The lease shall expiry at the end of the initial period for which it has been made for, or as the case may be, at the expiry of the period for which it may have been mutually renewed.

10.2 If the tenant fails to pay the rent in accordance with the clause 4 or if he fails to comply with any of the above terms or condition, the lease shall be null and void 8 days after the service of a\'\'MISE EN DEMEURE\'\' on the tenant at his expenses.

10.3 Without any prejudice to any legal action which the landlord shall be entitled to obtain poeion of the leased premises upon the application of a \'\'Writ Habere Facias Poeionem\'\' once thelease has become null and void.
