按照《劳动法》第五十条“工资应当以货币形式按月支付给劳动者本人。不得克扣或者无故拖欠劳动者的工资。”以及《工资支付暂行规定》第七条“工资必须在用人单位与劳动者约定的日期支付。如遇节假日或休息日，则应提前在最近的工作日支付。工资至少每月支付一次，实行周、日、小时工资制的可按周、日、小时支付工资”的规定，工资必须按月支付。

超过约定的工资发放日，就应视为拖欠工资。

有下列情形之一的，用人单位应当向劳动者支付经济补偿：

3、用人单位依照本法第四十条规定解除劳动合同的;

6、依照本法第四十四条第四项、第五项规定终止劳动合同的;

7、法律、行政法规规定的其他情形。
