船舶海上事故调查处理须知 Ship Maritime Casualty Investigation Proceing Instruction

1.目的

Objective 本规定旨在对船舶发生的海上事故及时得到报告并进行调查、处理和统计，以便认真吸取教训，加强防范，保障生产安全。

These provisions for veel to get report in maritime casualty and conduct the survey, proceing and statistics, so that seriously drawing leons from for effective prevention, ensure the production safety.2.适用范围

Scope of Application 2.1.本须知适用于船舶海上事故的调查和处理。

This Notice applies to investigation and handling of veel maritime casualty 3.职责

Obligation 3.1.安监部负责海损、火灾事故的调查、分析、提出处理意见，并进行统计报上级主管部门。 Safety supervision department is responsible for average, fire accident investigation, analysis and put forward disposal idea, and statistical submitted to higher authorities.3.2.机务部负责机损、污染事故的调查、分析、提出处理意见，并进行统计报上级主管部门。 Maintenance department is responsible for machine lo, pollution accidents investigation, analysis and put forward disposal idea, and statistical submitted to higher authorities.3.3.船员部负责海盗袭击、人身事故的调查、分析、提出处理意见，并统计报上级主管部门。

Crew department is responsible for pirate aault\\personal accident investigation\\analysis and put forward disposal idea, meanwhile statistical submitted to higher authorities.3.4.综合性的海上事故由指定人员组织，并会同有关职能部门进行调查和处理。

The comprehensive maritime casualty should be investigated and handled by designated personnel 3.5.总经理审批并签署处理意见。

General Manager should be responsible for approval and sign for disposal.3.6.船长负责向调查人员提交海事报告，提供船上有关法定和其它记录，以及船舶有关资

料，带领全体船员接受调查。

The captain is responsible for maritime report submitted to investigators, provide the ship relevant legal and other records, and ship relevant material, led the crew under investigation. 4.船舶海上事故分类

Claification of Veel Maritime Casualty.4.1.海上交通事故：包括碰撞、触损或浪损、触礁或搁浅、火灾或爆炸、沉没；

The maritime traffic accidents: including collision, damage through contact or swell damage, on the rocks or stranding, fire or blast, sinking.4.2.机损事故：包括航行中发生影响适航性能的机件或重要属具的损坏或灭失；

Machine lo accident: including sailing occurred in the influence of parts or important airworthine performance appurtenances provided the lo or damage; 4.3.人伤事故：包括人员受伤或死亡；

People injury accidents: including personnel injury or death; 4.4.污染事故。Pollution accidents.5.事故等级

Accidents rank 5.1.按《水上交通事故统计办法》所颁布的标准分为小事故、一般事故、大事故、重大事故及特大事故五个等级。

According to the standard which promulgated by the Water Traffic Accident Statistics Method, the standard divided into small accident, general accidents, big accident, serious accident and extra-large accident 5 grades.6.事故报告 Accident Report 6.1.船舶发生事故如为紧急情况应按SMP-0810船岸应急反应、训练、演习程序处置。 If the veel casualty is an emergency should as per SMP - 0810 ship-shore emergency preparedne and response and training and drill procedure disposal.6.1.1.事故发生后，船上写出SMP-0910不符合规定情况/事故/险情报告表报告公司相关职能部门，原因和性质查明后按照不符合规定情况、事故和险情程序的规定向公司指定人员报告。

After the accident, the veel should write SMP-0910 non-conformity/accident/mi risk report form report to related company functional departments, reasons and properties of such situations should report to the company concerning designated personnel as per after according to find out are not conformity with the provisions, accidents and danger.6.2.向主管机关报告 Report to the competent authority 6.2.1.船舶在国内沿海发生海上交通事故，应按《中华人民共和国海上交通事故调查处理条例》的规定向就近港口的海事机构报告并提交《事故报告》。

If veel interiorly coastal happened maritime traffic accidents, such veel should report the accident report and submit to the nearest harbour maritime authority as per the People\'s Republic of China Maritime Traffic Accident Investigation Handles Byelaw.6.2.2.船舶发生海上污染事故，应按规定向就近海事机构报告并提交《事故报告》。

If the veel had a pollution accident, such veel is required to report and submit to the maritime agencies report and submit it to the nearest harbour maritime authority.7.申请检验和出证

Apply for inspection and releasing certificate 7.1.因海事而遭受损坏或构成不适航问题时，应申请船检机构对受损部位进行检验。明确海损范围、原因和程度，并取得由其签署的海损鉴定书及临时适航证书。

If veel had suffered damage or constitute unseaworthine problem because of the maritime accident, such veel would apply inspection to the damaged area.Clear average range\\causes and extent, meanwhile achieved the Average Expertise Report and Temporary Airworthine Certificate by the Veel Inspection Authority.7.2.如水线以下受损，应申请潜水员进行水下检查，搞清船体包括船底板、螺旋桨、舵等的损坏情况，要求潜水员出具检查报告。

If there are damages below water line, the veel should apply for divers for underwater check to see into damages of hull including ship slab, the rudder propeller, meanwhile require the inspection report by the divers.7.3.如海事涉及两艘或两艘以上船舶，或固定建筑物，或其他财产遭受损失时，船长（或派大副）应上对方船上或其他受损现场察看船、货、物的受损情况，并应提出由我方派人参加检查，或申请联合检验，明确受损范围、程度及原因，防止对方以后任意扩大范围。

If maritime inspection involving two ships or two ships above ship, or fixed structure, or other property loes, the captain (or sending chief) should be on the other ships or other damage check the scene shipping agency, freight, content of the damaged condition, and shall put forward by us send someone to check, or apply for joint inspection, clear damaged scope, degree and the reasons, prevent arbitrary expansion after each other.7.4.发生火灾后，应申请检验并弄清损失情况及损坏范围。对于货损，船长应要求货物检验师分清火灾直接损坏或因救火造成的货损，以利共同海损。

After fire hazard, the veel should apply for inspection and clear lo situation and damage range.For cargo damages, the captain should request cargo docimaster to divide direct damage or for fire fighting fire caused damage to distinguish the general average.7.5.如发生机损，到达第一个港口后，应申请验船师对事故原因、损失范围、适航性等签具检验报告。

If there is machine lo, the veel should apply for surveyors to sign with inspection report since it arrived at the first harbour.7.6.发生严重油污事故后，应通过代理申请海事鉴定人员予以核定，特别应对污染程度、范围，对油污区船舶，其它建筑物的受污损，以及对海洋生态资源损坏已采取的清除措施及费用是否合理等方面出具证书。

After serious pollution accident, the veel should apply maritime judges to appraise through agent, especially to the pollution level\\range\\ the scope for pollution area, ships, and other buildings, andsign the certificate of measures of cleanup measures and fees whether reasonable for ocean ecological resource damage.8.事故调查

Accident investigation 8.1.船舶在接受事故调查前应准备下列有关文件和资料。 Before the veel in an accident investigation should prepare the following relevant documents and materials 8.1.1.事故报告；

Accident report 8.1.2.航海日志、轮机日志、车钟记录簿摘要及航向记录；

Logbook, engine log, car clock record book abstract and course records.8.1.3.取得轮机长关于操纵情况、舵机和主机工况的记述；

Obtain the report of chief engineer about manipulation, steering gear and main engine condition.8.1.4.作出事故示意图；

Make accident schemes 8.1.5.旁证材料（现场目击证明等）；

Circumstantial evidence material (eyewitne proof, etc.) 8.1.6.船舶损坏检验报告； Damage to ship inspection report 8.1.7.海图（作出标有双方船位置和风、流、潮等表明事故经过的海图，并保留海上原标航向、船位记录）；

Chart (make marked both ship position and wind, current and tide, etc which indicated proce of the accident, and keep the original standard sea heading, locality record) 8.1.8.甚高频无线电话记录； VHF wirele telephone records 8.1.9.三个以上船员的证明材料，并在事故报告上签署；

The accident report needed sign by three crew and their proof material.8.1.10.其它能说明情况的材料。

Other material which can explain the situation.8.2.指定人员收到“不符合规定情况、事故和险情报告单”后，经评审即转相关职能部门进行调查分析。对于综合性的事故，指定人员亲自组织，会同有关职能部门进行调查，必要时可要求公司其他人员协同参加。

When designated personnel received “non-conformity/accident/mi risk report”,accidents and danger report”, the report should transfer to relevant functional departments to diagnose after appraisal.For comprehensive accident, designated personnel should personally organize, jointly with the relevant functional departments investigation and, when neceary, require the company to other personnel synergy to attend.8.3.调查人员的职责 Investigators duty 8.3.1.调查应客观、全面，不受事故当事人提供材料限制。

Investigation should be objective, comprehensive, no restrictions of the materials which provide by accident parties.8.3.2.调查人员有权向事故发生的船舶及有关人员了解事故的有关情况和索取有关资料。 Investigators shall be entitled to understand the relevant information and obtain accident of relevant information from the veels and relevant personnel which has the accident happened.8.3.3.查明事故的原因、财产损失和人员伤亡情况。

Find out the cause, property damage and casualties of the accident.8.3.4.查明事故的性质和责任。

Find out character and responsibility of the accident.8.3.5.提交事故的调查报告。 Submit the accident report.9.事故处理

Treatment of the accident 9.1.对所发生的事故要认真吸取和总结教训，按SMP—0910不符合规定情况/事故/险情的报告和分析及纠正程序，提出防止类似事故再次发生而需采取的措施。

For given accident earnestly absorbed and sum up leons, according to the SMP-0910 non-conformity/accident/mi risk report and analysis and corrective procedures, put forward to prevent similar accidents and take measures.9.2.接受主管机关根据国家有关规定对当事船舶和人员作出的行政处罚决定。

Accepted the decision on administrative penalty made according to the relevant regulations of the state by competent authority to involved veel and personnel.9.3.根据事故情节，公司有关职能部门提出对事故的责任人给予必要的经济处罚的意见并填入事故处理项，报公司总经理批准后执行。

According to the plot, relevant department of company put forward financial penalty opinions for the responsible persons and fill in the accident treatment items, report to company general manager for approval before implementation.9.4.在查明事故原因的基础上，判明当事人的责任，对构成犯罪的移交司法机关追究刑事责任。

To distinguish the responsibility for the Parties in accident and turn the person to judiciary department if what he did constituted a crime, all above should on the basis of checking the cause of the accident.10.事故统计

Accident statistics 10.1.各主管部门应将公司发生事故的种类，按照相关规定进行统计并报上级主管部门。 The competent departments shall submit the accident species to the superior departments in according with the relevant provisions.11.相关文件
