一、***学院聘请***为英语教师。双方本着友好合作精神，自愿签订本合同并保证认真履行合同中约定的各项义务。

二、合同期自2016年1 月10日起至2017年12月31日止。

三、乙方的月薪为人民币8600元。甲方提供乙方一居室住房，若甲方不能提供住房，每月租房补贴2000元。

四、甲方的义务：

1.向乙方介绍中国有关法律、法规和甲方有关工作制度以及外国专家的管理规定。

2.对乙方的工作进行指导，检查和评估。

3.向乙方提供必要的工作和生活条件，协助乙方办理各种手续，包括居住证和专家证等。

4.按月支付乙方的报酬和乙方在职期间1次往返机票。 5.若法规许可，为乙方购买《人身意外伤害保险》并附加《意外医疗保险》。

五、乙方的义务：

1.遵守中国的法律，法规，不干预中国的内部事务。

2.遵守甲方的工作制度和有关外国专家的管理规定，接受甲方的工作安排，业务指导，检查和评估，未经甲方同意，不得兼任与甲方无关的其他劳务。

3.完成每周16节课时要求、参加英语角等课外活动和指导学生参加各种英语竞赛。按要求制定相应的教学计划和教学内容，事先交甲方审定，并按指定的时间和地点上课。按期完成工作任务，保证工作质量。在教学过程中，经甲方同意，乙方可适当调整教学计划或内容。乙方根据教学需要补充的教材、资料等，应经甲方同意，方可使用。当甲方对乙方进行教学评估时，乙方应予以合作。

4.尊重中国的宗教政策。不从事与教师身份不符的活动。不在学校和学生中宣传宗教。

5.尊重中国人民的道德规范和风俗习惯。

六、合同的变更，解除和终止：

1.双方应信守合同，未经双方一致同意，任何一方不得擅自更改、解除和终止合同。

2.经当事人双方协商同意后，可以变更，解除和终止合同。在未达成一致意见前，仍应当严格履行合同。

3.甲方在下述条件下，有权以书面形式通知乙方解除合同：

(1)乙方不履行合同或者履行合同义务不符合约定条件，经甲方指出后，仍不改正的;

(2)根据医生诊断，乙方在病假连续30天后不能恢复正常工作的;

4.乙方在下述情况下，有权以书面形式通知甲方解除合同;

(1)甲方未按合同约定提供乙方必要的工作和生活条件;

(2)甲方未按时支付乙方报酬。

七、违约金：

当事人一方不履行合同或者合同义务不符合约定条件，即违反合同时，应当向另一方支付20000元的违约金。

乙方因不可抗力事件要求解除合同，需出具有关机构证明，经甲方同意后，离华的费用自理;乙方若无故解除合同，除离华费用自理外，还应当向甲方支付违约金。

甲方因不可抗力事件要求解除合同，经乙方同意后，离华费用由甲方负担;甲方若无故解除合，除负担乙方离华费用外，还应当向乙方支付违约金。

八、本合同自双方签订之日起生效，合同期满即自行失效。当事人一方要求签订新合同，必须在合同期满30天前向另一方提出，经双方协商同意后签订新合同。

乙方合同期满后，在华逗留期间的一切费用自理。

九、仲裁

当事人双方发生合同纠纷时，尽可能通过协商或者调解解决。若协商，调解无效，可向国家外国家局设立的外国文教专家事务仲裁机构申请仲裁。

本合一式两份，每份都用中文和英文写成，两种文本具有同等法律效力。

EMPLOYMENT CONTRACT

Party A (Employing Party): Party B (Employed Party) Full Name: Paport No: I.Party A wished to engage the service of Party B as a foreign teacher.The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfil conscientiously all the obligations stipulated in it.II.The period of service will be from**, 2016 to **, 2017.III.Party B’s monthly salary will be 8600 RMB.Party A shall provide Party B a one- bedroom apartment.If no apartment is available, Party A shall Party B monthly housing allowance 2000 RMB.IV.Party A\'s Obligations 1.Party A shall introduce to Party B the laws, decrees and relevant regulations by the Chinese government, the Party A\'s work system and regulations concerning administration of foreign experts.2.Party A shall conduct direction, supervision and evolution of Party B\'s work.3.Party A shall provide Party B neceary working and living conditions and aist Party B to go through all the formalities, e.g.residence paper, foreign expert certificate.4.Party A shall pay Party B\'s salary regularly by the month and pay Party B the expense of one round-trip flight from Xiamen to London.

5.If laws and regulations permit, Party A shall buy Party B the personal accident insurance plus accidental medical insurance.V.Party B\'s Obligations 1.Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China\'s internal affairs.2.Party B shall observe Party A\'s work system and regulations concerning administration of foreign experts and shall accept Party A\'s arrangement direction, supervision and evolution in regard to his/her work.Without Party A\'s consent Party B shall not render service elsewhere or take any job unrelated to the work.3.Party B shall complete 16regular teaching hours per week and participate in the outside cla activities such as English corner activities and coach his students for contests.Party B shall take part in teaching or other related academic activities, if required, after cla.That shall not be included in the regular teaching hours.Party B shall work out the outlines of the claes and the schedules of the claes and present them to Party A for approval.Party B shall give leons in the given claroom at the given time.When deemed advantageous, Party B may, with the consent of Party A, adjust his or her syllabi, use self-prepared materials, videocaettes or other materials.Party B shall perform all the tasks agreed on schedule and guarantee the quality of work.When Party A evaluates Party B\'s work, Party B is advised to offer cooperation.4.Party B shall respect China\'s religious policy, and shall not conduct, religious activities among his students and colleagues, incompatible with the status of a teacher. 5.Party B shall respect the Chinese people\'s moral standards and customs.VI.Revision, Cancellation and Termination of Contract 1.Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.2.The contract can be revised, canceled, or terminated with mutual consent.Before both parties have reached an agreement, the contract should be strictly observed.3.Party A has the right to cancel the contract with a written notice to Party B under the following conditions: (1) Party B does not fulfil the contract or does not fulfil the contract obligations according to the terms stipulated, and has failed to amend after Party A has corrected it.(2) According to the doctor\'s diagnosis.Party B cannot resume normal work after a continued 30 day sick here.4.Party B has the right to cancel the contract with a written notice to Party A under the following conditions: (1) Party A has not provided Party B with neceary working and living conditions as stipulated in the contract.(2) Party A has not paid Party B as scheduled.VII.Breach Penalty When either of the two parties fails to fulfil the contract of fails to fulfil the contract obligations according to the terms stipulated, that is, break the contract, it must pay a breach penalty of US 20000 RMB.

If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A\'s consent and pay its own return expenses; If Party B cancel the contract without valid reason, it should pay its own return expenses and pay a breach penalty to Party A.

If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses; if Party A cancel the contract without valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.VIII.This contract takes effect on the date signed by both parties and will automatically expire when the contract ends.If either of the two parties asks for a new contract, it should forward its request to another party 30 days prior to the expiration of the contract, and sign the new contract with mutual consent.

Party B shall bear all expenses incurred when staying on after the contract expires.IX.Arbitration

The two parties shall consult with each other and mediate any disputes which may arise about the contract.If all attempts fail, the two parties can appeal to the organization of arbitration for foreign expert affairs in the State Bureau of Foreign Experts and ask for a final arbitration.

This contract is signedin the Chinese and English language, both texts being equally authentic.
